The Post-Standard issued a correction in its print edition today about the charges Dr. Dhafir was convicted of.  We are grateful for this and continue to hope that it will publish attorney Steve Downs’ OpEd on the case.

Convictions in Dr. Dhafir’s case were affirmed by the Second Circuit Court of Appeals but the case was sent back to Judge Mordue for resentencing. The court decision can be read here.

Dr. Dhafir’s lawyers will file a petition for a rehearing en banc (all the judges on the court of appeals) because they believe that the court’s analysis of the sentencing issue is inconsistent with the holding of a fairly recent Supreme Court case.  They will also renew their challenge on convictions on at least one ground.
